Privacy Policy

Last updated: 21 October 2026

This Privacy Policy explains how BlackForest Media handles personal information when you visit my website or contact me through the website’s enquiry form or published email address.

1. Who is responsible for your information?

The operator responsible for the personal information described in this policy is:

Legal name: Tobias Schendel
Trading name: BlackForest Media
Postal address: Rio Santiago 118, 48312 Puerto Vallarta, Jalisco, MEXICO
Website: https://www.blackforest-media.com/
Privacy contact: Tobias Schendel
Email: tobiasschendel.contact@gmail.com

In data protection terminology, the operator is the “controller” or “responsable” for the processing described in this policy.

2. Information you provide

When you use the contact form or email us, I process the information needed to handle your enquiry. This can include:

Your name.

  • Your email address.

  • The subject and content of your message.

  • Business or project details you choose to include.

  • Subsequent correspondence relating to your request.

The contact form is intended for business enquiries and does not ask for sensitive personal information. Please provide only information relevant to your request.

Providing information is voluntary. However, we need a way to contact you and enough information about your enquiry to respond or prepare a quotation.

If a project requires additional categories of personal information or a different use of that information, I will provide further information when relevant.

3. Information processed when you visit the website

The website’s hosting and media infrastructure receives technical information needed to deliver the pages and resources you request.

This can include your IP address, the date and time of a request, the requested page or file, browser and device information, and technical information relating to errors or security events.

Cookies and similar technologies may also process information as described in Section 6.

4. Why I use personal information

I use information for the following purposes:

  • To display and operate the website, including its portfolio and contact functionality.

  • To respond to enquiries and discuss potential projects.

  • To prepare quotations and take steps requested before entering into a contract.

  • To maintain relevant correspondence.

  • To protect the website and communications against misuse, spam and security incidents.

  • To handle privacy requests and meet applicable legal obligations.

Legal grounds where the GDPR applies

Where processing is subject to the General Data Protection Regulation, the relevant grounds are:

  • Steps before entering into a contract — Article 6(1)(b): responding to your request for a quotation or discussing a service you may personally purchase.

  • Legitimate interests — Article 6(1)(f): operating a reliable and secure website, responding to general business correspondence, and communicating with representatives of prospective business clients. These interests are considered alongside the rights and interests of the individuals concerned.

  • Legal obligations — Article 6(1)(c): complying with obligations that provide a valid legal basis under the GDPR.

  • Consent — Article 6(1)(a): optional processing for which consent is required, as specified when consent is requested.

Where I rely on consent, you can withdraw it for future processing. Withdrawal does not affect processing that was lawful before the withdrawal.

5. Service providers and other recipients

Wix

The website uses Wix for hosting and website functionality, including the delivery of website content and processing associated with the contact form.

Wix.com Ltd. and its relevant affiliates and service providers process information needed to provide these services. Where Wix processes information on my behalf, its Data Processing Addendum governs that processing.

Further information:

Email

Our published contact address uses Gmail. Emails sent to that address, including their contents and attachments, are processed through Google’s email service.

Further information:

Information may also be disclosed when required by law or where necessary to establish, exercise or defend legal rights.

6. Cookies, analytics and other integrations

This website uses Wix cookies and similar technologies for security and basic website functionality.

With your permission, Wix also uses analytics cookies to help me understand how visitors use the website.

You can accept or reject optional cookies and change your preferences through the website’s cookie settings.

7. Where your information is processed

I operate from Mexico. I use Wix to host this website and handle contact-form submissions, and Gmail, provided by Google, for email correspondence.

These providers operate internationally, so personal data may be stored or processed outside Mexico and the European Economic Area.

Wix describes its international processing and safeguards in its Data Processing Addendum. For transfers covered by European data-protection requirements, these include adequacy decisions and, where applicable, standard contractual clauses or other recognized safeguards.

Google explains its processing arrangements in its Privacy Policy and its information on international data transfers.

You can contact me at tobiasschendel.contact@gmail.com for further information about the processing described in this policy.

8. How long information is kept

I retain enquiry information while handling the enquiry and completing any agreed follow-up.

After that, I retain information only where there is a specific continuing need, such as documenting an agreement, meeting a recordkeeping obligation, or establishing, exercising or defending legal rights. In those circumstances, I retain the relevant information for the applicable period.

When information is no longer needed, it is deleted or anonymised, subject to applicable requirements concerning restricted retention or blocking.

Technical information is retained according to its operational or security purpose and the relevant service arrangements.

9. Your privacy rights

Your rights depend on the law applicable to the processing.

Where the GDPR applies, you may have rights to access your information, correct inaccurate information, request erasure, restrict processing, object to processing based on legitimate interests, and receive or transfer certain information in a portable format.

Where Mexican data protection law applies, you may exercise rights of access, rectification, cancellation and opposition, known as ARCO rights.

You can also contact me to request limits on the use or disclosure of your information or to withdraw consent where processing relies on it. Some information may need to be retained or processed where a legal exception applies.

How to make a request

Email tobiasschendel.contact@gmail.com and include:

  • Your name and a way to contact you.

  • The information or interaction your request concerns.

  • The right you wish to exercise or the change you are requesting.

I may need information to verify your identity or your authority to act for someone else. I will explain what is required and how to provide it.

Where the GDPR applies, I respond without undue delay and normally within one month. If a permitted extension is necessary, I explain the reason and applicable timeframe.

For ARCO requests under Mexican law, I communicate a decision within 20 business days and, if the request is approved, implement it within the following 15 business days. Permitted extensions will be explained.

Complaints

Where the GDPR applies, you may complain to a competent data protection supervisory authority, including the authority in the country of your habitual residence, place of work or the alleged infringement.

Where Mexican private-sector data protection law applies, the supervisory authority is the Secretaría Anticorrupción y Buen Gobierno.

10. Changes to this policy

I update this policy when the website, my processing activities or relevant requirements change.

The latest version will be available on this page, with its update date shown at the top. I will provide additional notice or request consent where required by applicable law.
